CITY COUNCIL

OCTOBER 3, 2016

7:00 P.M.

The Council of the City of Augusta, Kansas met in regular session on October 3, 2016, with Mayor Matt Childers presiding.  Council present were Jason Lowery, Cale Magruder, Jamie Crum, Paul Belt, Tom Leffler and Justin Londagin.  Council members Mike Rawlings and Ron Reavis were absent. Also present:  City Attorney Austin Parker, Assistant City Manager Cody Sims and City Clerk Erica Jones.  Visitors present were: Airport Manager Lloyd Partin, Belinda Larsen, John Black, Tiffany Gillespie, Eric Birk, Matthew Pray, Roberta Bond, Leslie Bond and Kathy McClure.

Prayer:   Pastor Cale Magruder, First Southern Baptist Church, gave the invocation.

 

Minutes: Leffler made a motion to approve the minutes from the September 19, 2016 Council meeting.  Lowery seconded the motion. Motion carried without opposition.

           

Ordinance 9A:  Leffler made a motion to approve Ordinance 9A in the amount of $1,216,038.22.  Lowery seconded the motion. Motion carried without opposition.

 

Visitors:

Tiffany Gillespie, representing the downtown merchants, was present to request approval of the annual Witches Night Out event and closure of the 500 block of State Street from approximately 6 p.m. to 8:30 p.m. on October 20, 2016 for the annual Witches Dance Event. Crum made a motion to approve the annual Witches Night Out event and closure of the 500 block of State Street from approximately 6 p.m. to 8:30 p.m. on October 20, 2016 for the annual Witches Dance Event. Lowery seconded the motion. Motion carried without opposition.

 

Les Bond, 1515 Washington Lane, addressed the governing body about the condition of the street on Washington Lane. He stated the road is covered in pot holes and in complete disrepair. Bond presented a petition to the council from the property owners in the area and asked for the council to repair Washington Lane between Kelly and Shirley Avenues. The Mayor stated that he has turned the petition over to Leffler who will follow up with the Public Works Director to inquire about the status of this particular street.

 

Business:

Temporary Commercial Lease Agreement between the City of Augusta and Pray Aviation, Inc.: Leffler made a motion to approve a temporary commercial lease agreement between the City of Augusta and Pray Aviation, Inc. Lowery seconded the motion. Motion carried without opposition.

 

Fishing Dock Proposal for Augusta City Lake by Liebe’s EZ Dock:  Magruder made a motion to accept the Park Advisory Board’s recommendation to approve a proposal from Liebe’s EZ Dock for three (3) docks to be installed at Augusta City Lake. Belt seconded the motion. Motion carried without opposition.

                       

            Magruder made a motion to approve Purchase Order No 2016-56.1 authorizing staff to purchase fishing docks from Liebe’s EZ Dock in the amount of $39,849. Belt seconded the motion. Motion carried without opposition.

 

Accept General Warranty Deeds for Right of Way Acquisition Related to the South Ohio Street Project:  Lowery made a motion to accept a Warranty Deed for Right of Way Acquisition from Moore Property investments, LLC. for $2,000 related to the South Ohio Street Project. Belt seconded the motion. Motion carried without opposition.

 

Update on Charitable Donations on Utility Bills and the Landfill Coupon Program:  Jones provided an update on charitable donations on utility bills and the use of the landfill coupon program.

           

Matters From/For Council and Informational Memorandum:

Reminder of the League of Kansas Municipalities Conference in Overland Park October 8-10th.

 

Leffler made a motion to postpone the joint work session with the Park Board scheduled at Santa Fe Lake for October 10, 2016 at 6:00 p.m. to a future date yet to be determined.  Londagin seconded the motion. Motion carried without opposition.

 

Leffler: Leffler made a motion to schedule a joint work session with the Advisory Board for October 10, 2016 at 6:00 p.m. at the Airport to discuss future plans and vision for the Airport. Lowery seconded the motion.  Motion carried without opposition.

 

            Leffler asked for an update about the Neighborhood Revitalization Plan (NRP).  Sims stated he received a call from the Assistant Attorney General today clarifying a few things the Attorney General’s Office would like to see in the interlocal agreements going forward, but that the NRP was approved and they will be sending a confirmation letter out tomorrow.

 

Magruder: Magruder stated he was contacted by a citizen on Osage about a cattle truck that is parking in the area of her home without cleaning the truck out after its use causing a decreased quality of life due to the odor.  Magruder stated she contacted the Safety Department and Inspection Department and we do not currently have anything on the books to address this and other noxious odors.  Parker said there is nothing readily available in the code to address this, but if it is the will of the governing body he will review this with staff and other communities to see what kind of ordinance can be drafted to address this. Leffler stated that they could be slopping the manure out when they move it so we may be able to address the spillage.  The consensus of the governing body was to have Parker and staff work on how to address this issue.

 

Executive Session:

At 7:33 p.m. Lowery made a motion to go into executive session for 10 minutes under the attorney-client relationship exception to the Kansas Open Meetings Act to discuss matters deemed privileged in the attorney-client relationship.  Lowery asked that Assistant City Manager Cody Sims and City Attorney Austin Parker join the Council in the executive session.  The governing body will reconvene in the Council Chambers at 7:43 p.m. Leffler seconded the motion.  Motion carried without opposition.

 

At 7:43 p.m. Lowery made a motion to exit executive session with no action being taken.  Leffler seconded the motion. Motion carried without opposition.

 

Adjourn:  At 7:43 p.m. Londagin made a motion to adjourn. Lowery seconded the motion.  Motion carried without opposition.
