CITY COUNCIL

JANUARY 18, 2016

7:00 P.M.

 

The Council of the City of Augusta, Kansas met in regular session on January 18, 2016, with Mayor Matt Childers presiding. Council present were Jason Lowery, Cale Magruder, Paul Belt, Tom Leffler, Mike Rawlings, Ron Reavis and Justin Londagin. Councilwoman Crum was absent. Also present: City Attorney Austin Parker, City Manager Josh Shaw, Assistant City Manager Cody Sims, Public Works Director Jaime Goering, Director of Electric Utility Bill Webster, and City Clerk Erica Jones.  Visitors present were: Belinda Larsen, John Black, Jim Sutton, Connie Thurman, Shirley Stueven, and Mark Chesney.

Prayer: Councilman Magruder gave the invocation.

 

Minutes: Rawlings made a motion to approve the minutes from the January 4, 2016 Council meeting. Lowery seconded the motion.  Motion carried without opposition.

           

Ordinance 12C: Leffler made a motion to approve Ordinance 12C in the amount of $1,594,503.35.  Rawlings seconded the motion.  Motion carried without opposition.

 

Business:

Resolutions Authorizing the City’s Continued Participation in the Kansas Power Pool: Rawlings made a motion to approve Resolution 2016-02 authorizing the City to continue its participation in the Kansas Power Pool, a Municipal Energy Agency, by executing the Second Amendment to the Agreement creating the Kansas Power Pool. Lowery seconded the motion.  Motion carried without opposition.

 

            Leffler made a motion to approve Resolution 2016-03 authorizing the City’s continued participation in the Kansas Power Pool, a Municipal Energy Agency, by approving the Second Amended Operation Agreement-subject to the following conditions:  1) The proposed amendments to Articles III and Section 13 of the 2nd Amended Operating agreement that were approved by the KPP’s Board of Directors at the January 14, 2016 meeting shall be presented to the individual member cities of KPP for their approval. 2) Upon unanimous action of the member cities of KPP approving the attached amendment, the amendment will be adopted and the Second Amended Operating Agreement shall be changed as reflected in the amendment. 3) That the foregoing is accomplished before the Operating Agreement is signed and executed by the City of Augusta. Lowery seconded the motion.  Motion carried with Londagin voting in opposition.

 

2016 Street Sales Tax Program Recommendations: Reavis made a motion to approve of the Sales Tax Advisory Committee’s recommendation for the 2016 Street Sales Tax Program and authorize staff to proceed with drafting an engineering services agreement with MKEC for presentation at the February 1, 2015 meeting. Lowery seconded the motion.  Motion carried without opposition.

 

Bid Award for Community Development Department Vehicles: Magruder made a motion to approve a bid award to the low bidder, Rusty Eck Ford, in the amount of $20,327 for a new 2016 Ford F-150 for the Environmental Inspector. Lowery seconded the motion.  Motion carried without opposition.

 

            Magruder made a motion to approve a bid award to the low bidder, Rusty Eck Ford, in the amount of $20,327 for a new 2016 Ford F-150 for the Parks & Recreation Division Foreman.  Lowery seconded the motion.  Motion carried without opposition.

 

Resolution Scheduling a Public Hearing for a Dangerous Structure Located at 347 East Main Street: Magruder made a motion to approve Resolution 2016-04 scheduling a public hearing for the condemnation of property located at 347 East Main Street for Monday, March 7, 2016 at 7:00 p.m. at Augusta City Hall, pursuant to the provisions of K.S.A. 12-1750 et seq.  Lowery seconded the motion.  Motion carried without opposition.

 

Matters From/For Council:

Discussion regarding 1% Local Option Sales Tax scheduled to expire in September of 2016. Reavis made a motion to schedule a work session for Monday, January 25th at 7 p.m. to discuss the 1 % Local Option Sales Tax.  Leffler seconded the motion.  Motion carried without opposition.

 

Informational Memorandum:

Belt: Belt stated a citizen told him it is difficult to locate on the city website when the limb yard is open and to find the trash schedule for the holidays.

 

Executive Session:

At 7:30 p.m. Lowery made a motion to go into executive session for 60 minutes under the preliminary discussions regarding acquisition of real property, attorney-client relationship, and personnel matters of non-elected personnel exceptions to the Kansas Open Meetings Act to discuss the following matters:

 

  1. Preliminary discussions regarding acquisition of property for expansion of public facilities;

  2. Discussion on matters deemed privileged in the attorney-client relationship; and

  3. Discussion regarding the City Manager’s annual performance evaluation and contract.

     

    Lowery asked that City Manager Josh Shaw, Assistant City Manager Cody Sims, and City Attorney Austin Parker join the Council in the executive session. The governing body will reconvene in the Council Chambers at 8:30 p.m. Magruder seconded the motion. Motion carried without opposition.

     

    Lowery made a motion to exit executive session with no action being taken. Rawlings seconded the motion. Motion carried without opposition.

     

    Lowery made a motion to extend the City Manager Josh Shaw’s contract for two years, extending it to December 31, 2018, and including a 2.5% merit increase. Rawlings seconded the motion. Motion carried without opposition

     

     

    Adjourn: At 8:32 p.m. Londagin made a motion to adjourn. Rawlings seconded the motion. Motion carried without opposition.
